HHS announces final rule to enhance Federal Independent Dispute Resolution

The U.S. Department of Health and Human Services has issued a final rule to enhance the dispute resolution process under the No Surprises Act, including reduced fees and new batching options for claims.

The U.S. Department of Health and Human Services (HHS) has announced a final rule regarding the No Surprises Act. This action streamlines the Federal Independent Dispute Resolution (IDR) process, the agency says.

One of the main updates aims to enhance the provider-payer out-of-network payment dispute resolution procedure. Additional key changes:

  • The cutback on ineligible disputes
  • Administrative fees for each dispute have been lowered by $100 for everyone involved
  • Claims can “be resolved together in one batched dispute,” with limits on how many
  • Payers must “use standardized claim codes when communicating about out-of-network services”

Additionally, these updates set the stage for the IDR Gateway. This tool is a space for users to oversee disputes and will be available in 2026.
